"San Francisco 49ers linebacker Aldon Smith was not drinking at Ray McDonald’s house, as suggested in a search warrant affidavit released by the courts on Monday, his agent said. “The allegation in the affidavit is completely false,” agent Doug Hendrickson told CSNBayArea.com. “He was not there drinking.” Hendrickson said Smith went to visit McDonald in the afternoon before making an appearance later that day at a children's charity event in San Jose. “This is unfortunate because we’re talking about a kid who is doing everything right, working in the community and with kids,” Hendrickson said of Smith. “And his name gets lumped into this and it’s all anybody is talking about.” Smith was suspended for nine games to begin this season for violations of the NFL’s substance abuse and personal conduct policy. In July, a Santa Clara County Superior Court judge sentenced Smith to three years probation after pleading “no contest” to weapons and DUI charges. McDonald was named as a suspect last week in a sexual assault investigation.
